As a healthcare professional, you will have access to sensitive information. You agree to keep all Medical History, treatment plans, and diagnostic details strictly confidential.
Information Security
- Non-Disclosure: You shall not share patient data with any third party outside the JOPANA application.
- Data Retention: You are prohibited from storing patient medical records on personal devices or external cloud services. All charting and reporting must be done exclusively within the JOPANA app.
Breach of Contract & Termination
JOPANA reserves the right to monitor compliance with these terms. If you breach any of the aforementioned clauses:
- Immediate Termination: JOPANA is authorized to terminate your subscription and permanently blocklist you from the platform.
- Legal Action: JOPANA reserves the full right to initiate legal proceedings for damages, professional malpractice, or breach of confidentiality.
Core Healthcare Tracking (Strictly Necessary)
JOPANA uses continuous tracking to ensure patient safety and care delivery:
- Electronic Visit Verification (EVV): Mandatory GPS and time tracking for caregivers to verify that scheduled home visits occurred as planned.
- Secure Session Management: Tokens that keep your medical portal active and secure during a care session to prevent unauthorized access to health records.
Clinical Purpose of Tracking
We track activity at all times while the app is in use for these specific medical purposes:
- Medication Adherence: Monitoring interactions with digital prescriptions to ensure patients follow their specific treatment plans.
- Service Partner Coordination: Tracking caregiver status to allow to receive real-time updates.
Strict Healthcare Compliance
Our tracking technologies are designed to meet the highest regulatory standards:
- HIPAA Compliance: We do not disclose Protected Health Information (PHI) to third-party tracking vendors without a signed Business Associate Agreement (BAA).
- Medical Secrecy: All data collected via trackers is treated with the same confidentiality as your physical medical records.
- No Marketing Trackers: JOPANA does not use third-party advertising cookies to sell your health-related interests to advertisers.
Data Security & Storage
- Encryption: All tracking data is encrypted using AES-256 at rest and TLS 1.2+ during transmission to prevent data breaches.
- Retention: Tracking logs related to medical visits are retained for at least 6 years to comply with legal healthcare audit requirements.
JOPANA HIPAA Authorization & Tracking Consent
I. Authorization to Use and Disclose Protected Health Information I, hereby authorize JOPANA Home Healthcare to use and disclose my Protected Health Information (PHI) through its mobile application tracking technologies.
II. Specific Information to be Tracked & Disclosed This authorization specifically includes the following data points collected while the app is active:
- Location Data (GPS): For Electronic Visit Verification (EVV) to confirm Service Partner arrival and patient safety.
- Activity Logs: Timestamps of medication adherence, symptom reporting, and care interactions.
III. Purpose of Tracking The information will be used for the following clinical and administrative purposes:
- Clinical Monitoring: Real-time health oversight by licensed medical professionals.
- Emergency Response: To dispatch assistance based on tracked vitals or location.
- Regulatory Compliance: To meet federal EVV mandates for Medicaid/Medicare-reimbursed services.
Recipients of Information
I understand that my tracked PHI may be shared with:
- My designated primary care Healthcare Service Partner and clinical care team.
- Emergency services (in the event of a medical alert).
- State and federal health agencies (for audit and EVV compliance).
Your Rights & Signature
- Right to Revoke: I may withdraw this authorization at any time by contacting JOPANA support. Revocation will stop all future tracking but will not affect data already processed.
- Impact of Refusal: I understand that refusing to sign may prevent JOPANA from providing certain home care services that require remote monitoring or EVV.
- Expiration: This authorization remains valid till subscription expiries from the date of signature. Acceptance: By clicking "I Agree" or continuing to use the JOPANA Service Partner App, you verify that you have read, understood, and bound yourself to these Terms and Conditions.
